Kevin J. O’Neill is a partner with Byrne & O’Neill. He has more than 22 years of experience litigating various construction related matters on behalf of design professionals in New York and New Jersey State and Federal Courts as well as before arbitration panels and various administrative tribunals. He also counsels and represents clients in negotiating and drafting construction contracts, transactional matters, and general corporate issues.
Mr. O’Neill earned his undergraduate degree at Colgate University in 1982 and he received his Juris Doctorate from St. John’s law school in 1987. He is admitted to the State and Federal bars of the States of New York and New Jersey.
He has represented design professionals for more than two decades in a variety of contexts, from partnership formation and dissolution issues to catastrophic tort litigation and virtually every type of claim in between (commercial claims, delay claims, fee disputes, defamation claims, bodily injury claims, property damage claims, intellectual property disputes, risk management, risk assessment, succession issues, among others). For instance, he represented the AOR for the World Trade Center in mass tort litigation in the Southern District of New York.
Mr. O’Neill has appeared on behalf of design professionals in litigation matters from inception through trial and appeal, in State and Federal Courts in NY and NJ. He has been a writer and speaker in various public forums on topics of interest to design professions, including risk management, worksite safety issues/liability, contract language, design/build project delivery systems, and alternative dispute resolution methodologies. Mr. O’Neill has also represented design professionals in administrative hearings concerning professional practice and licensure issues both at the City and State levels. He has received Judicial Decisions of interest to the design community in New York and New Jersey State and Federal Courts, and continues to devote his professional practice to the representation of the design community.
